Article 3 – Applicability These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the general terms and conditions can be viewed at the entrepreneur’s premises and will be sent free of charge upon request. If the distance contract is concluded electronically, the text of these general terms and conditions can be provided electronically so that it can be stored easily on a durable data carrier. If this is not possible, the entrepreneur will indicate where the terms and conditions can be accessed and how they can be obtained free of charge. For specific product or service terms, the consumer may rely on the provision that is most favorable to them in case of conflicting terms. If one or more provisions in these terms are void or nullified, the remaining provisions will remain in force, and alternative arrangements will be made. Unforeseen situations or ambiguities must be assessed in accordance with the spirit of these general terms and conditions.
Article 4 – The Offer If an offer has a limited validity period or is subject to conditions, this will be explicitly stated. The offer is non-binding and may be adjusted by the entrepreneur. The offer contains a complete and accurate description of the products and/or services. Any images are truthful representations. Apparent mistakes or errors do not bind the entrepreneur. The price, including taxes, any shipping costs, payment methods, right of withdrawal, and other relevant terms will be stated in the offer.
Article 5 – The Agreement The agreement is concluded when the consumer accepts the offer and meets the stated conditions. For electronic acceptance, the entrepreneur immediately confirms receipt. Until this confirmation is received, the consumer may cancel the agreement. The entrepreneur takes appropriate technical and organizational measures for electronic contracts and payments. If there are doubts about the consumer’s financial situation, the entrepreneur may refuse an order or impose additional conditions. The entrepreneur provides written information about the right of withdrawal, guarantees, and complaint handling with the product or service.
Article 6 – Right of Withdrawal The consumer has a 14-day cooling-off period to cancel the contract without providing reasons. This period begins the day after the product is received. During the cooling-off period, the consumer must handle the product and packaging with care. If the right of withdrawal is exercised, the consumer must return the product in its original condition and packaging according to the entrepreneur’s clear instructions.
Article 7 – Costs in Case of Withdrawal The consumer bears the cost of returning the product. Upon withdrawal, the amount paid will be refunded within 14 days, provided the returned product is received or proof of return is given.
Article 8 – Exclusion of Right of Withdrawal The right of withdrawal may be excluded for products that:
- Are custom-made.
- Are personal in nature.
- Cannot be returned due to their nature.
- Perish quickly.
- Have specific hygiene requirements and whose seal has been broken. The right of withdrawal is also excluded for services such as lodging, transport, or leisure activities with a fixed date.
Article 9 – The Price Prices will not be increased during the validity of the offer, except for VAT rate changes. Price increases after the contract is concluded are only permitted under specific conditions and with the consumer’s right to cancel. All prices include VAT and are subject to printing and typographical errors.
Article 10 – Conformity and Warranty The entrepreneur guarantees that the products comply with the contract and legal requirements. Defects must be reported within 14 days of delivery. The warranty is void if the product is misused or if the consumer attempts self-repair.
Article 11 – Delivery and Execution The entrepreneur carefully delivers products within 30 days unless otherwise agreed. If delivery is delayed or impossible, the consumer will be informed and has the right to cancel the agreement and receive a refund within 14 days. The risk of damage and loss lies with the entrepreneur until the product is delivered.
Article 12 – Long-Term Transactions: Duration, Termination, and Renewal The consumer may terminate an indefinite-term contract at any time with a maximum one-month notice period. Fixed-term contracts may be terminated at the end of the term with the same notice period. Silent renewal of contracts is allowed under specific conditions, where the consumer always retains the right to timely termination.
